HOOSICK FALLS, N.Y. (NEWS10) – The law firm that has been representing people in Hoosick Falls dealing with PFOA water contamination has now filed a lawsuit on behalf of a construction company.

Weitz and Luxenberg is representing R.M. Bacon, an excavation and construction company, in a suit against Saint-Gobain Performance Plastics and Honeywell.

The suit alleges the companies are responsible for the PFOA contamination, which hurt business for R.M. Bacon.

“If the tests are correct, which I’m assuming they are, we have the cleanest water, but you still have the stigma that you’re not going to erase for a long, long time,” R.M. Bacon owner Mike Bacon said.

According to the complaint, the contamination caused property values to decline, which caused a drop in development in the area and forced the company to sell off equipment and reduce staff to just one employee.

“The minute the contamination was reported, all contracts and all work that we had for the year were instantly pulled,” Bacon said.

Bacon said those contracts included new work, a horse barn, and an arena set to be built that was then dropped.

“That was his main concern: that their would be nobody willing to come here because of that,” he said.

It also affected regular day-to-day work, too.

“Normally, we would fix everybody’s driveway for the season or blacktop, put a pool in or deliver them top soil. That’s all gone away,” Bacon said. “Nobody wants to put any money into their yard because of the property value loss that they’re faced with.”

Bacon said he had to sell equipment that took years to pay off in order to keep his business open. He also had to lay off numerous employees. But his downsize is not just his loss.

“We went from burning $250,000 of fuel a year to burning $20,000 worth of fuel a year in our equipment, so your fuel guy’s been affected,” he said.

A barn, also part of his business, now empty.

“If the beef was polluted, I didn’t want to be feeding our local community with polluted beef, so we sold our beef here off,” he said.
