COULTER, Henry -JOHNSTON, Arthur

 

To the Register appointed by Act of Parliament for registering deeds wills and so forth in Ireland.

 

A Memorial of an indenture or mortgage bearing date the 13th day of July 1866 made between Henry COULTER[1] of Carrickastuck[2] in the County of Louth farmer of the one part and Arthur JOHNSTON[3] of Dundalk in the County of Louth attorney at law of the other part. Whereby it is witnessed that in consideration of the sum of £46 lent and advanced to said Arthur JOHNSTON the receipt whereof the said Henry COULTER did thereby acknowledge he the said Henry COULTER did grant bargain sell alien release and confirm unto the said Arthur JOHNSTON all that those that part of the lands of Carrickastuck as the aforesaid containing by estimate 44 acres three roods and 30 perches Irish plantation measure[4] be the same more or less bounded on the North by the River[5] which separates it from the lands of Shortstone[6] on the East and Southeast by the stream which separates it from the lands of Cloughmaguigan[7] on the South by part of the lands of Baronstown[8] and on the Southwest West South and North West by part of the lands of Carrickastuck as particularly mentioned in a certain lease thereof made 28 day of January 1819 Alexander DONALDSON[9] of the one part and Henry COULTER[10] who was the grandfather of said Henry COULTER party hereto of the other part for three lives renewable forever and under which lease said Henry COULTER holds the same situate in the parish of Philipstown Barony of upper Dundalk and County of Louth. To have and to hold the said lands tenements and premises with the appurtenances unto the said Arthur JOHNSTON his heirs and assigns to the only proper use and behoof of the said Arthur JOHNSTON his heirs and assigns forever subject to the condition for redemption of said premises thereafter contained upon payment to said Arthur JOHNSTON his exhors admons or assigns of the said sum of £46 with interest thereon as therein mentioned which said deed as to the execution thereof by the said Henry COULTER and Arthur JOHNSTON respectively is witnessed by Bernard CLARK[11] of Millpark[12] in the County of Louth law messenger and Augustus GRAHAM[13] of Lisdoo[14] in the County of Louth writing clerk and this Memorial as to the execution thereof by the said Arthur JOHNSTON is witnessed by the said Bernard CLARK of Millpark in the County of Louth law messenger and John McCABE[15] of Dundalk in the County of Louth law messenger. Arthur JOHNSTON [seal]. Signed sealed and delivered by the said Arthur JOHNSTON in presence Bernard CLARK. John McCABE. The above named Bernard CLARK of Millpark in the County of Louth law messenger age 16 years and upwards maketh oath and says that he was present and did see the above named Arthur JOHNSTON of Dundalk in the County of Louth attorney at law of duly executed the indenture of mortgage of which the above writing is a Memorial and also to the above Memorial respectively and did see the said Henry COULTER of Carrickistuck in the County of Louth farmer duly execute the said indenture mortgage of which the above writing is a Memorial and saith the name Bernard CLARK subscribed as a witness to the said indenture mortgage and to the above Memorial respectively as one of the witnesses to the same as this deponent proper name and hand writing Bernard CLARK sworn before me this third day of August 1866 at Dundalk in the County of Louth and Master extraordinary of the High Court of Chancery in Ireland for taking affidavits in said County and I know deponent John M. [1] Henry COULTER of Carrickastuck in the County of Louth farmer, grandson of Henry COULTER.

[2] Carrickastuck, a townland of 229 acres in the Parish of Phillipstown, Co. Louth.

[3] Arthur JOHNSTON of Dundalk in the County of Louth attorney at law. Mr. Arthur Johnston, Solicitor, of Lisdoo, son of Dr. Johnston, of Carrickbroad [Parish of Killevy, Co. Armagh], and brother of the late James Johnston, J.P., D.L., served his apprenticeship with Mr. Peter M'Evoy Gartlan, a famous Solicitor in the early Repeal Movement, and who defended O'Connell in the early forties [1840s] on the charge of high treason, and got him acquitted. Mr. Johnston devoted himself to the Bankruptcy branch of the legal profession before it was transferred from the County Courts to the High Courts, and was a recognised authority on that subject. He died at Lisdoo in 1902. His daughters are Mrs. Alexander A. Watters, and Mrs. E. Johnston. SOURCE: Tempests Jubilee 1909 p 94.

[4] The curious thing about this mention of the 44acres, 3 roods and 30 perches is that this would seem to be the same land referred to in earlier deeds – and yet, there is no mention of a Henry COULTER being in possession of such lands at the time of the Griffiths Valuation in 1864. The only lessee of lands in Carrickistuck that would be sizable enough at the time of Griffiths Valuation would have been Anne COLTER who leased 74 acres from Edward MARTIN and 68 acres from Alexander BELLS. It is most likely that she was the mother of Henry COULTER and the widow of Ralph COULTER. Since she died July 23, 1864 and was a widow, this it quite possible. (SOURCE: Will probates at PRONI). I have studied the maps at www.askaboutireland.ie and am none the wiser. At present, I do not have access to better maps.

[5] Castletown River flows long the upper border of Carrickastuck.

[6] Shortstone There are two townlands: Shortstone East & Shortstone West, both in the Parish of Roche.  I would expect that Shortstone West is the townland in question. In the 1854 Grifffiths Valuation, pretty much the whole townland is owned in fee by a Robert BAYLEY. The only part that is not is a house and small garden held in fee by Mary COULTER, who would have been the widow of the Samuel COULTER who was murdered in 1851. Her maiden name was BAILIE and I suspect that she was a sister of this Robert BAYLEY.

[7] Cloughmaguigan

[8] Barronstown, a townland of 513 acres in the Parish of Barronstown, is bordered by Carrickastuck and Philipstown on the North North/east; by Clonaleenan and Derryfalone on the west and by Cunnicar, Maghereagh, Ballinurd, Balrobin and Milltown on the south. The first three townlands have generatinons-long associations with DICKIEs COULTERs and BAILIEs (amongst other family members).

[9] Alexander DONALDSON (1771-1843), of Philipstown in the County of Louth Esquire. A well to do man who started building Phillipstown House in Co. Louth in 1826. When his nephew Alexander Charleton died in 1828, he was grief-stricken enough to stop work on it. "After Alexander Charleton's death his brother William Charleton came to live with him and died there on 25Sept1875 age 77, unmarried. This William in his will dated 24 April 1872 left all his real estate to his nephew Thomas William BELL who completed building the house." The will of Alexander Donaldson (dated 25 May 1843) left his relatives Alexander McELROY part of his land - also William CHARLETON. "In 1834 he owned 30 good acres in arable state, 10 acres arable, 10 acres pasture and 2 marsh."

He also owned land in Annaletten, Co. Monaghan and in Gibstown, Co. Louth; he served on the Grand Jury of Louth and was also High Sherriff.  SOURCE: Irish Edition of Alexander ban DONALDSON p252 and 254.

[10] Henry COULTER was the grandfather of said Henry COULTER was the son of James COULTER and father of Ralph COULTER (who was the father of the Henry COULTER of the first part).
